1. Agreement to Terms & Corporate Authority
These Terms of Service ('Terms') represent a legally binding agreement between you and the New York Council of the Navy League of the United States ('Council', 'we', 'us', or 'our'). By accessing our website (nynavyleague.org), applying for membership, purchasing tickets, donating, or participating in Council events, you agree to comply with and be bound by these Terms and our Privacy Policy.
If you are using these services on behalf of an organization, military command, sponsor, or legal entity, you represent and warrant that you possess full corporate or organizational authority to bind that entity to these Terms.
2. Eligibility & Age Restriction
You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to enter into binding legal agreements, register administrative accounts, execute financial contributions, or apply for membership through our digital services. Minors participating in affiliated youth cadet organizations may only do so with verifiable enrollment executed by a parent or legal guardian.
3. Membership Subscriptions, Automatic Renewals & Cancellations (ROSCA Compliance)
In compliance with federal and state subscription transparency statutes, including the Restore Online Shoppers' Confidence Act (15 U.S.C. § 8401 et seq.) and applicable state renewal regulations:
A. Automatic Renewal Terms
If you enroll in an ongoing recurring membership tier (such as annual dues), your membership will automatically renew at the conclusion of each billing period at the then-current standard rate, using the payment method on file, unless you cancel prior to the renewal date.
B. Transparent Cancellation Policy
You may cancel your recurring membership renewal at any time without penalty, fee, or hidden procedural barrier. To cancel, simply send written notice to info@nynavyleague.org or call (212) 825-7333 prior to the commencement of the subsequent billing cycle. Upon receipt, your recurring billing profile will be deactivated immediately.
C. Contributions and Dues Non-Refundable
Membership dues and charitable donations immediately support operational programs, youth cadet units, and sea service welfare initiatives. Except where mandated by applicable law or agreed to in writing, all membership payments, donations, and event sponsorships are final and non-refundable.
4. Event Ticketing, Attendance & Military Decorum
Registration for Council functions—including the Annual Navy Birthday Ball, Coast Guard Day, Fleet Week receptions, and the New York Maritime Security Conference—is subject to venue capacity, formal security protocol, and dress codes.
The Council reserves the right to refuse admittance or eject any person whose conduct is disruptive, belligerent, or contrary to the decorum, safety, and operational dignity of our military guests and venue partners. Event registrations are personal to the registrant and may not be resold or transferred without express Council permission.
5. Intellectual Property & Trademark Protection
All materials on this website—including but not limited to text, historical narratives, crests, logos, graphic design, audio, photographs, videos, and custom software code—are the intellectual property of the Council or its content licensors and are protected by United States and international copyright, trademark, and trade dress laws.
You may not scrape, reproduce, republish, distribute, broadcast, or commercially exploit any material from this website without prior written authorization from the Council.
6. Digital Millennium Copyright Act (DMCA) Safe Harbor & Takedown Policy

9. Disclaimers of Warranties
TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, THE WEBSITE, SERVICES, AND ALL ASSOCIATED CONTENT ARE PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS. THE COUNCIL EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. 10. Limitation of Liability
TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, IN NO EVENT SHALL THE COUNCIL, ITS TRUSTEES, DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOSS OF REVENUE, DATA, OR GOODWILL) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE WEBSITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100.00 USD) OR THE AMOUNT YOU PAID TO THE COUNCIL IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify, defend, and hold harmless the Council and its officers, directors, volunteers, and agents from and against all third-party claims, damages, liabilities, losses, judgments, and expenses (including reasonable attorney fees) arising from: (a) your violation of these Terms; (b) your violation of any third-party rights, including intellectual property or privacy rights; or (c) your willful misconduct or unlawful actions on our platforms.
12. Governing Law, Exclusive Jurisdiction & Dispute Resolution
These Terms and any dispute arising hereunder shall be governed by, construed, and enforced in accordance with the laws of the State of New York, without regard to its conflict-of-law principles.
Any judicial proceeding, claim, or controversy arising out of or relating to these Terms or the Council's digital platforms shall be instituted exclusively in the state or federal courts located in the County of New York, State of New York. You irrevocably submit to the exclusive personal jurisdiction and venue of such courts and waive any objection grounded in forum non conveniens.
13. Severability & Entire Agreement
If any provision of these Terms is determined by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision will be narrowed or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. These Terms constitute the complete and exclusive agreement between the parties regarding the subject matter herein.
